Notice of the General Office of the Department of Ecology and Environment of Shanxi Province on Matters Concerning the Out-of-Province Transfer for Utilization of Industrial Solid Waste (Excluding Hazardous Waste)

To the Ecology and Environment Bureaus of all cities:

In accordance with the relevant provisions of the Ecological and Environmental Code of the People's Republic of China, and in order to further standardize the management of the out-of-province transfer for utilization of industrial solid waste (excluding hazardous waste) in our province, this notice is hereby issued in light of the actual circumstances of our province.

I. Fully Implement New Legal Requirements

Article 476, Paragraph 2 of the Ecological and Environmental Code of the People's Republic of China stipulates that entities transferring solid waste outside the administrative regions of provinces, autonomous regions, or municipalities directly under the Central Government for utilization shall submit relevant information in advance, through the solid waste pollution prevention and control information platform and other channels, to the competent ecology and environment authorities of the provincial people's governments where the solid waste is transferred from and received. All entities generating industrial solid waste (hereinafter referred to as “waste-generating entities”) shall strictly implement the above provisions and, in accordance with the requirement of “submission before transfer,” use the National Solid Waste Information System to complete the submission of relevant information before transferring industrial solid waste (excluding hazardous waste) outside the province for utilization.

For projects that completed filing in accordance with Jinhuanhan [2021] No. 616 before August 15, 2026, but have not yet completed all actual transfers, relevant information on the remaining industrial solid waste not yet transferred shall be resubmitted through the National Solid Waste Information System in accordance with the requirements of this Notice.


II. Standardize System Registration and Information Submission

The National Solid Waste Information System has officially launched the submission function for the cross-provincial utilization of solid waste. Entities in our province (including enterprises and individual industrial and commercial households) engaged in the out-of-province transfer for utilization of industrial solid waste (excluding hazardous waste) shall promptly log in to the National Solid Waste Information System (website: https://www.cswm.org.cn/system/#/login) to complete registration and submit relevant information. For specific operating instructions, please refer to Appendix 1 and Appendix 2.


III. Strengthen Environmental Supervision

The ecology and environment bureaus of all cities shall actively publicize and explain relevant policies, urge waste-generating entities within their jurisdictions that engage in the cross-provincial transfer for utilization of industrial solid waste to promptly complete system registration and submit relevant information in a standardized manner; comprehensively strengthen routine supervision and management, make effective use of the National Solid Waste Information System, regularly retrieve records of cross-provincial transfers out of and into their jurisdictions of industrial solid waste, and properly implement relevant requirements for the management of the cross-provincial transfer for utilization of industrial solid waste; strengthen comparison with the Industrial Solid Waste Management Ledger of waste-generating entities, promptly organize verification of any abnormal leads identified, and prevent unauthorized out-of-province transfers of industrial solid waste for utilization without prior submission; and strengthen process supervision to resolutely prevent illegal dumping and disposal of industrial solid waste within their administrative regions during transfer.

For illegal acts such as transferring industrial solid waste outside the province for utilization without submitting information in advance as required, or illegally dumping or disposing of industrial solid waste during transfer, ecology and environment departments at all levels shall investigate and handle such acts in accordance with the relevant provisions of laws and regulations, including the Ecological and Environmental Code of the People's Republic of China.

The Provincial Department of Ecology and Environment will rely on the National Solid Waste Information System to conduct risk screening of data on cross-provincial transfers out of and into the province for the utilization of industrial solid waste, issue early warnings for abnormal information, and refer such cases to the relevant localities for verification. At the same time, it will coordinate with ecology and environment departments of other provinces to carry out joint prevention and control supervision of cross-provincial transfers.

Should the ecology and environment bureaus of any city encounter issues during policy implementation or system use, please promptly report them to the Provincial Department of Ecology and Environment (Division of Solid Waste and Chemicals).

As of the date of issuance of this Notice, the Notice of the Department of Ecology and Environment of Shanxi Province on Further Improving the Filing Management of Out-of-Province Transfer for Utilization of Solid Waste (Excluding Hazardous Waste) (Jinhuanhan [2021] No. 616) shall be repealed simultaneously.

Description of the Cross-Provincial Utilization Submission Function:

After a waste-related entity selects [Cross-Provincial Utilization Submission for Solid Waste] as its business type, it shall submit the application under the [Solid Waste] - [Cross-Provincial Transfer-Out Utilization Submission] menu.

This includes basic information on the transfer-out entity, basic information on the receiving entity, transportation information, solid waste information, and attachment information. The basic information on the transfer-out entity includes the entity name, entity address, legal representative, contact person, and contact telephone number, which are automatically populated from the entity's basic information. The basic information on the receiving entity includes the entity name, entity address, administrative region, environmental impact assessment approval document for the utilization project, legal representative, contact person, and contact telephone number. This information is entered by the transfer-out entity.

Transportation information includes the transfer start date, transfer end date, transportation method (road, rail, or waterway), proposed transportation origin, proposed transportation destination, and transportation route. The transport entity name, Unified Social Credit Code, and prefecture-level cities en route are optional. When waterway transportation is selected, the departure port and arrival port must be declared.

For solid waste generation information, declare the actual address where the solid waste is generated, the administrative division, and the corresponding ecology and environment department (select the provincial, municipal, or county-level ecology and environment department).

Solid waste information includes the waste category (select from the solid waste catalog), waste code (select from the solid waste catalog), waste name (enter), quantity (enter), physical form (select), and packaging (select). Multiple solid waste entries may be added by clicking the [Add] button.

The utilization and disposal method is fixed as comprehensive utilization. The description of the utilization and disposal method is selectable from the following options:

R1 - Recycling/reclamation of organic materials,

R2 - Recycling/reclamation of inorganic materials,

R3 - Recovery/regeneration of acids or bases,

R4 - Recovery/regeneration of organic chemical substances,

R5 - Recovery of inorganic substances,

R6 - Use as raw material for fuel production,

R7 - Direct use as fuel for energy recovery (generation of electricity or steam),

R8 - Substitution for industrial raw materials,

R9 - Land utilization,

R10 - Production of construction materials,

R11 - Use as fill material in engineering works,

R12 - Pre-treatment for utilization operations,

R99 - Other. After selecting R99 - Other, a description of the utilization and disposal method must be entered.

Attachment information includes the solid waste utilization contract, the business license of the receiving entity, and proof of qualifications of the receiving entity.

After data submission, click the Submit button. Once submitted, the data is successfully reported and does not require confirmation by the ecology and environment department.
